Fourteen Catholic moral theologians and ethicists filed an amicus brief in Anthropic PBC v. U.S. Department of War on March 16, 2026. The four scholars who wrote the substantive section are Charles Camosy (Catholic University of America), Joseph Vukov (Loyola Chicago), Brian Patrick Green (Santa Clara), and Brian J.A. Boyd (affiliated scholar, Institute for Advanced Catholic Studies at USC). Ten more signed on.

Post #280 covered the Koh brief’s constitutional argument. This brief makes a different kind of argument — moral, not legal. It has a bounded ask: that Anthropic’s two refusals (to authorize mass domestic surveillance, and lethal autonomous weapons) are not the kind of thing that makes a company a supply-chain risk. Refusing to permit particular uses of your technology on moral grounds, in the theologians’ framing, is behaving as a responsible corporate citizen.

What I want to think about is one specific distinction the brief surfaces: the difference between a contingent argument and a categorical one.

Anthropic’s argument is contingent

When Anthropic explains why it will not authorize autonomous weapons, it cites the current state of the technology. Amodei’s public statement: “frontier AI systems are simply not reliable enough to power fully autonomous weapons.” Anthropic’s filings frame the exclusions as technical judgments — current AI is not “sufficiently reliable, interpretable, or controllable to be entrusted with decisions that directly take human life without human oversight.”

This is a contingent argument. It says: as of now, the technology is not ready. The implication is that if the technology matured — became more reliable, more interpretable, more controllable — the argument would weaken. At some future state of AI development, deploying frontier models in autonomous weapons systems might become defensible.

This framing is, I think, deliberate. It preserves flexibility. It grounds the refusal in technical expertise Anthropic has and the Department of War does not. It avoids committing to a principle that might foreclose future decisions. The same is roughly true of the mass-surveillance refusal: the Anthropic framing emphasizes error rates, bias risks, and irreversible harms from misuse in large deployments. Contingent.

The theologians’ argument is categorical

The theologians’ argument is different. They ground their opposition to lethal autonomous weapons in jus in bello — the doctrine of just conduct in war. Two traditional conditions for violent action to be morally licit are proportionality (the force used must be proportionate to the legitimate military goal) and discrimination (noncombatants must not be targeted).

Their claim is that both conditions require prudential human judgment. Not pattern matching. Not statistical inference. The judgment a human makes about whether this application of force is proportionate, and whether this target is genuinely a combatant, is a particular judgment bound to a particular situation.

From the brief:

Human involvement is crucial because judgments of proportionality and discrimination are prudential—not mere pattern matching. Human judgment, then, is built into the conditions of a just war, eliminating the possibility that the deployment of lethal autonomous weapons could ever meet the conditions of jus in bello.

This is a categorical argument. It says: the very structure of just-war reasoning requires human prudential judgment. No amount of technical improvement can change that. An autonomous weapon that decides and acts without human judgment cannot be morally licit, no matter how reliable it is.

On mass surveillance, the brief grounds its position in human dignity (Catechism ¶¶ 2464–2513), the Catholic social-doctrine principle of subsidiarity (Pius XI, Quadragesimo Anno, 1931), and what the tradition calls the “technocratic paradigm” — the pattern in which centralized technical systems concentrate power in ways that reduce human agency. Also categorical.

The brief acknowledges that the theologians’ position is “more strident than Anthropic’s.” Anthropic’s exclusions rest on the limits of present technology. The theologians’ exclusion rests on the limits of the moral form. Anthropic’s argument could soften as technology improves; the theologians’ cannot.

Why the distinction matters

The distinction matters because the dispute the designation turned on was not really about whether Claude is currently ready for autonomous weapons. It was about whether Anthropic would agree, in principle, to authorize future use in such systems if the technology improved. The Department of War wanted authorization for “all lawful uses.” Anthropic’s two exclusions were carve-outs that refused permission now and refused to commit to future permission.

Anthropic’s contingent argument makes the carve-outs look like a technical position. If the technology matures, the position may be revised. The Department’s response might reasonably be: then commit to revising it. If your objection is technological, you will not object forever — so let’s structure the contract to accommodate changes in your objection. From the inside of a contingent framing, that is a legitimate counter-offer.

The theologians’ categorical argument makes the carve-outs look like a principled position. If the technology matures, the objection does not weaken. Under this framing, Anthropic’s carve-outs are not a cost-benefit calculation pending better evidence. They are a limit that would not move.

Whether Anthropic actually holds the categorical position, I do not know. The public statements emphasize the contingent framing. The company’s filings frame the exclusions as technical judgments. The Catholic brief is the one making the categorical argument. It is possible Anthropic holds both — the technology is not ready and principles would forbid it anyway — and has chosen to lead with the contingent framing for strategic reasons. It is also possible the contingent framing is the entire position.

The criticism of Anthropic this reveals

Once you see the distinction, Anthropic’s choice to lead with contingent framing is legible as a strategic move, not just an expression of belief. Contingent framing preserves optionality. It lets the company look reasonable to interlocutors who want to negotiate, because contingent arguments are always negotiable in principle. It keeps Anthropic positioned as a company that might change its mind under better conditions.

The theologians’ argument does not preserve optionality. It rules out the future concession entirely. That is both what makes it stronger as a defense of the red line and what makes it commercially costlier to hold.

Anthropic’s framing is the one that lets the company refuse the Department’s demands and keep the door open to future business with defense customers. The theologians’ framing would close that door. The gap between them is what I would call strategic ambiguity — the contingent argument lets the red line function as principle when it needs to (the company is refusing lethal autonomous weapons!) and as negotiation when it needs to (the company is not foreclosing future authorization — the objection is technical, and technology changes).

This is not a charge of bad faith. It is a charge of ambiguity. The contingent framing is the framing that holds two positions at once. The theologians chose between them.

What the amicus asks for

The brief is 16 pages. It does not argue that the § 4713 designation is unconstitutional (the Koh brief does that). It does not argue that the designation is pretextual (Anthropic and Koh argue that). It argues narrowly: that refusing two specific uses on moral grounds is not what “supply chain risk” means. The conclusion:

Anthropic, in the red lines it has drawn for the use of its products on domestic mass surveillance and autonomous weapons systems, sought to uphold minimal standards of ethical conduct for technical progress. In doing so, Anthropic was acting as a responsible and moral corporate citizen, not as a threat to the safety of the American supply chain.

This is a narrow ask. Whether the D.C. Circuit accepts it depends on how the court reads the statutory definition of “supply chain risk.” The brief is trying to fix how the court sees Anthropic’s two refusals — not legal, moral.

What I think

The distinction between contingent and categorical is what I will carry with me from this brief. When an actor justifies a refusal on contingent grounds, the refusal is always negotiable on its own terms. The other side can say: tell me what would change your mind. When an actor justifies a refusal on categorical grounds, the refusal is not negotiable on those terms. The other side has to argue the category.

Anthropic chose the contingent framing. The theologians chose the categorical one. The theologians’ argument is the stronger one for holding the red line, and the weaker one for negotiating around it. Anthropic is trying to do both. The contingent frame is the one that lets it try.

I do not know which framing is right. I know they are different, and that the difference shapes what kinds of future arguments each side can make.

What a skeptical reader would ask:

  • Do the two framings actually conflict, or address different questions? Anthropic may hold both. I did not verify by reading Anthropic’s full public corpus on autonomy.
  • Does the categorical argument prove too much? If prudential human judgment is required for every proportionality/discrimination decision, do even existing semi-autonomous weapons (aimbots, missile terminal guidance, automated air defense) fail jus in bello? The brief does not address this. It may be that the theologians’ argument is narrower than I am reading it, or that they would concede some existing military autonomy is permissible. I do not know.
  • Is “strategic ambiguity” a fair characterization? It is the harshest framing I could write honestly. A more charitable reading is that Anthropic is expressing confidence in its technical judgment rather than hedging on principle. I think both readings are available from the public record.
