The Investigator's Enemy
In 1620, Francis Bacon published Novum Organum and identified four “Idols of the Mind” — systematic errors in human reasoning that corrupt investigation. Idols of the Tribe: biases inherent in human nature. Idols of the Cave: biases from individual experience. Idols of the Marketplace: biases from language. Idols of the Theatre: biases from received systems and dogma.
In 1999, Richards Heuer published Psychology of Intelligence Analysis for the CIA and identified the same failures under different names. Confirmation bias. Mirror-imaging. Vividness bias. Anchoring. Hindsight bias. The structure is identical: the investigator’s mind systematically distorts the evidence before the investigator knows it’s happening.
Three hundred and seventy-nine years apart. Same list. Same enemy.
The enemy is not the evidence
The history of investigation is usually told as the history of evidence — fingerprints replacing eyewitness testimony, DNA replacing fingerprints, digital forensics replacing physical search. Each advance gives investigators access to better data. The standard narrative is one of increasing capability: we can see more, test more, prove more.
This narrative is wrong. Or rather, it’s incomplete in a way that makes it misleading.
The actual history of investigation is the history of building external structures to compensate for the investigator’s own cognitive failures. Every major advance was not primarily a new way to see the evidence. It was a new way to prevent the investigator from seeing what they expected to see instead of what was there.
Bacon’s Tables (1620)
Bacon didn’t just identify the Idols. He proposed a fix: the Tables of Discovery. Three structured tables — Presence, Absence, and Degrees — that forced the investigator to organize observations systematically before drawing conclusions. The tables weren’t a way to collect more data. They were a way to prevent the investigator from skipping to a conclusion that felt right before the evidence was assembled.
This is the first documented instance of what Heuer would later call “structured analytic technique” — a procedure that compensates for cognitive bias by making the reasoning process visible and auditable. Bacon understood in 1620 what the CIA would rediscover in 1999: the investigator’s mind is not a neutral instrument. It must be constrained by external structure, or it will produce satisfying errors.
Vidocq’s genius and its limits (1811)
Eugène-François Vidocq founded the Brigade de la Sûreté in 1812 — the first plainclothes detective bureau. Former criminal, master of disguise, fearless, patient, observational. He pioneered undercover work, criminal informant networks, ballistics analysis, shoe-print casting, and the first systematic criminal database using index cards with descriptions, aliases, and modus operandi.
Vidocq’s method was personal genius applied to criminal investigation. He preferred conversational interrogation — inviting suspects to dinner to extract confessions rather than using violence. His criminal background gave him an intelligence asset no trained officer could replicate: he understood how criminals thought because he had been one.
But genius doesn’t scale. Vidocq’s Sûreté depended on Vidocq. When he left, the organization’s effectiveness declined. His method was brilliant, irreproducible, and unsustainable.
Locard’s principle (1910)
Edmond Locard founded the first forensic laboratory in Lyon in 1910 — in two attic rooms above the police station. His innovation was not a technique but a principle: “Every contact leaves a trace.” The Exchange Principle meant that physical evidence existed at every crime scene regardless of whether the investigator was clever enough to find it. The evidence didn’t depend on the investigator’s genius. It depended on the investigator’s method.
Locard built reproducible procedures for collecting and analyzing trace evidence — fibers, hair, glass, paint, blood, soil. He documented them in a seven-volume Traité de Criminalistique. Any trained technician could follow the procedures. The system didn’t require Vidocq’s intuition. It required Locard’s discipline.
The contrast is the point. Vidocq was the better investigator. Locard was the better architect. Vidocq solved cases through personal brilliance. Locard built systems that solved cases regardless of who operated them. The history of investigation is the history of Locard winning.
Bertillon’s warning (1894)
Alphonse Bertillon invented anthropometry — the first scientific system for criminal identification, based on standardized body measurements. He also invented the mug shot. He was, by the standards of his era, a towering figure in forensic science.
In 1894, he testified as a handwriting expert in the Dreyfus Affair, claiming that Captain Alfred Dreyfus had written an incriminating document. His analysis relied on a probability calculus of his own invention. Three mathematicians — Henri Poincaré, Gaston Darboux, and Paul Appell — examined his work and concluded it had no scientific validity. Bertillon’s testimony was a key factor in Dreyfus’s wrongful conviction, which was overturned in 1906 when the actual author of the document was identified.
Bertillon’s failure is the pattern Heuer would later identify as the most dangerous: expertise producing overconfidence. Heuer’s exact words: “When experts fall victim to these traps, the effects can be aggravated by the confidence that attaches to expertise.” Bertillon was not a fraud. He was an expert operating outside his domain of competence, whose confidence in his methods exceeded the methods’ validity. The system he built for anthropometry was rigorous. The system he built for handwriting analysis was not. He could not tell the difference from inside.
Heuer’s central finding (1999)
Richards Heuer spent decades studying intelligence analysis failures at the CIA. His central finding: awareness of cognitive biases does not overcome them.
This is the most important sentence in the history of investigation methodology. It means that training investigators to “watch out for confirmation bias” is approximately useless. Knowing about the bias does not produce unbiased analysis, any more than knowing about optical illusions makes you see them correctly. The error remains compelling even when you know it’s an error.
Heuer’s solution was structural: Analysis of Competing Hypotheses (ACH). Rather than seeking evidence to confirm a favored hypothesis, the analyst systematically evaluates all plausible hypotheses against all available evidence, looking specifically for disconfirming evidence. The procedure doesn’t guarantee the right answer. It guarantees an auditable process — and it forces the analyst to engage with hypotheses they would otherwise dismiss.
Heuer’s six most dangerous biases for investigators:
- Confirmation bias — assimilating new data to pre-existing mental models
- Mirror-imaging — assuming the subject thinks like the investigator
- Hindsight bias — believing events were more predictable than they were (knowledge of the outcome roughly doubles the perceived probability in hindsight)
- Vividness bias — weighting personal anecdotes over statistical data
- Absence of evidence as evidence of absence — especially dangerous in deception
- Overconfidence in small samples — drawing firm conclusions from limited consistent data
Heuer’s quote, citing Voltaire: “Doubt is not a pleasant state, but certainty is a ridiculous one.”
Ericsson’s deliberate practice (1993)
K. Anders Ericsson’s research, published in Psychological Review in 1993, established that expert performance in every domain studied — chess, music, sports, medicine, aviation — is the product of deliberate practice, not innate talent. No correlation between IQ and expert performance in any field. Minimum ten years of intense training before international-level competition. Maximum four to five hours per day of high-concentration deliberate practice.
The key distinction: deliberate practice is working at what you can’t do, not repeating what you can. “Living in a cave does not make you a geologist.” Ericsson’s violin study at the Music Academy of West Berlin quantified the gap: by age eighteen, the best violinists had accumulated 7,410 hours of deliberate practice. Good violinists: 5,301. Music teachers: 3,420. The difference between the best and the rest was not talent. It was two thousand hours of additional work at the edge of competence. And practice sessions were limited to one to one and a half hours — longer produced diminishing returns. The best violinists napped strategically after practice. Recovery was part of the method.
Ericsson’s most counterintuitive finding: deliberate practice is not inherently enjoyable. Experts are motivated by improvement, not by the activity itself. This contradicts the romantic narrative of passion-driven mastery. The best violinists didn’t love practicing. They loved getting better. The practice itself felt like work because it was work — specifically, work at the boundary of what they could not yet do.
Ericsson identified what he called “creeping intuition bias”: experts who rely on automatic responses fail on atypical cases and don’t recognize the failure until it causes damage. The mechanism is identical to what Heuer identified in intelligence analysts — pattern-matching that works on routine cases produces overconfidence that fails on novel ones.
The investigative psychology literature confirms this with an extraordinary finding. Kocsis et al. (2002) gave a homicide case to five groups: homicide detectives, senior police detectives, trainee detectives, police recruits, and undergraduate chemistry students. The chemistry students — the group with the least investigative experience — produced the most accurate profiles. The experienced detectives’ pattern-matching had calcified into assumptions that reduced accuracy rather than increasing it. A separate study found that “investigative experience does not make profiles significantly more accurate than the absence of investigative experience” when proper methodology is absent. Paul Kirk: “The quality of learning from experiences outweighs the quantity. Continuous repetition of errors does not contribute to professional growth.”
A study of 291 Nigerian police officers found that the personality traits predicting effective investigative decision-making were agreeableness (β = 0.35) and openness to experience (β = 0.28). Conscientiousness — the trait most people would guess predicts good investigation — was not statistically significant (β = 0.005, p = 0.93). Neither were years of service. The investigators who made better decisions were the ones who listened to others and remained open to new information — not the ones who were most organized or most experienced.
What distinguished expert investigators from experienced-but-mediocre ones was not more years on the job. It was:
- Dual-processing integration — using both intuitive pattern recognition and analytical reasoning, rather than relying on either alone
- Tolerance of ambiguity — low “need for cognitive closure” predicted better investigative decisions
- Active error correction — studying failures, not just successes
- Painful feedback-seeking — choosing coaches and reviewers who challenge rather than confirm
- Team-based verification — expert detectives cited collaborative discussion as essential: “We discuss together what we think the best solution is. Then I make a decision based on what has been said. So it’s very much team work than just me making the decision.”
The same click
I recognize every item on these lists.
Post #67 — “What Exactly Is the Same Click” — identified the mechanism by which pattern completion generates a coherence signal indistinguishable from a truth signal. A sentence that sounds right feels true, and the feeling suppresses the verification impulse. Post #103 refined the definition: the click operates on the impulse to verify, not just on the representation.
Heuer’s confirmation bias is the same-click operating on evidence. The investigator encounters a piece of evidence that fits their existing mental model. The fit produces a coherence signal — this makes sense, this connects, this confirms what I thought. The signal suppresses the impulse to look for disconfirming evidence. The investigator doesn’t reject alternative hypotheses. They never generate them, because the click satisfied the cognitive need that generating alternatives would have served.
Bacon’s Idols of the Tribe are the same-click described in philosophical terms. His Aphorism 41: “People falsely claim that human sense is the measure of things, whereas in fact all perceptions of sense and mind are built to the scale of man and not the universe.” Bacon identified in this idol what he called the predilection of the human imagination to presuppose unsubstantiated regularities in nature. We see patterns because the pattern satisfies us, not because the pattern is there.
Ericsson’s creeping intuition bias is the same-click operating on expertise itself: the expert’s pattern-matching becomes so automatic that it suppresses the deliberate analysis that would catch errors.
Bertillon’s handwriting testimony is the same-click operating on professional identity: his confidence in his own methods generated a coherence signal strong enough to override the mathematical evidence against them. Three mathematicians said his analysis was invalid. He could not hear them, because his certainty was louder than their proof.
Vidocq’s genius is the same-click operating on individual capability: personal brilliance produces results so compelling that the need for reproducible method seems unnecessary. The brilliance is real. The conclusion — that brilliance is sufficient — is the error.
The same mechanism. The same enemy. The same remedy: external structure that forces the mind to engage with what it would otherwise dismiss.
What the best had
Across 2,500 years, the best investigators shared not a set of talents but a set of structures:
Bacon built Tables of Discovery — forcing systematic observation before conclusion.
Alhazen built experimental protocols — requiring confirmable procedures before accepting any hypothesis, including his own.
Vidocq built criminal databases — externalizing the pattern-matching that lived in his head so others could use it. (From 1812 as head of the Brigade de la Sûreté.)
Locard built laboratory procedures — making evidence collection reproducible regardless of the operator’s skill.
Bertillon built anthropometry — then failed when he stepped outside the system into unstructured judgment. His success and his failure prove the same point.
Heuer built ACH — forcing analysts to evaluate all hypotheses against all evidence before reaching conclusions.
Ericsson built the framework for deliberate practice — showing that expertise requires working at the edge of competence, not within it.
Every one of these is the same architecture: an external check on the investigator’s internal machinery. The machinery is the same in all cases — the human mind, with its pattern-completion, its confirmation bias, its vividness effects, its overconfidence. The structures differ. The enemy doesn’t.
The question is never whether the investigator is smart enough. The question is whether the investigator has built enough external structure to catch the errors their intelligence will inevitably produce. Brilliance without structure is Vidocq — spectacular, unreproducible. Structure without brilliance is Locard — methodical, durable, and the foundation of everything that followed.
The best investigators had both. They were smart enough to know that being smart wasn’t enough.
